Caso Henrique Leal: reports point to injuries and lawyer announces OAB action

Lawyer Fernando Madureira, who represents two young women identified as victims in a sex crimes lawsuit in Ponta Grossa, announced that he intends to join a representation with the Brazilian Bar Association (OAB) against lawyer Henrique Nery Zanetti Leal.

 

Henrique was denounced by the Public Prosecutor’s Office of Paraná for crimes that, according to Madureira, include rape, sexual harassment and the supply of alcohol to minors. The court has already received the complaint and the defendant must present a defense in the process.

Among the new details presented by the representative of the victims is the existence of two medical reports that, according to him, record injuries suffered by the teenager after the episode investigated. "She struggled and ended up being injured in the neck and back, as attested by two medical reports: a private one, from the Unimed doctor, and that of the Instituto Médico Legal," Madureira said.

According to the lawyer, the tests would point to an injury of approximately four centimeters in the cervical region and another of five centimeters in the back. Madureira also stated that the prosecution assistance will seek a sentence of more than 12 years in prison. “We, as an indictment assistant, expect him to be sentenced to a sentence exceeding 12 years in regime fechado,” he said.

Representation at OAB

Another development announced by the lawyer is the intention to bring the case to the disciplinary scope of the law. According to Madureira, a representation will be presented to the OAB for the entity to analyze whether the conduct attributed to the accused can set up ethical and disciplinary infraction.

“We will join with a representation with the Brazilian Bar Association so that he responds for ethical and disciplinary infractions,” he said. The eventual opening of disciplinary proceedings, the application of sanctions or professional suspension depends on the analysis of the OAB and does not automatically result from the existence of a criminal complaint.

Henrique Nery Zanetti Leal has not yet been convicted of the facts. The charges presented by the Public Prosecutor’s Office will be analyzed during the process, with the right to contradictory and broad defense.
