Drivers were speeding in accident with 23 deaths in Ipiranga

The accident happened on August 19. According to the evidence produced, the front collision was caused by a combination of factors involving both vehicles.

The Civil Police of Ipiranga, concluded the investigations on the tragic accident that occurred in the early hours of August 19 this year, at kilometer 209 of the BR-373 highway, in Ipiranga, which resulted in the death of 23 people.

According to the tests produced, the frontal collision was caused by a combination of factors involving the two vehicles, such as the speeding. The accident involved a truck from the company Meggatrans that broke into the opposite track, and a minibus belonging to the municipality of Imbituva, which transported patients for examinations and medical consultations.

The violent impact claimed the lives of 22 occupants of the bus (including the driver) and the truck driver. Five other people, all passengers of the collective, survived with injuries.

Irregularities in the truck

The forensics revealed serious failures in the driving and maintenance of the truck. Telemetry data showed that the vehicle was traveling at 80 km/h just before the crash, in a stretch where the maximum allowed speed was 60 km/h. In addition, the expert reports pointed out that the vehicle presented wear that reduced the braking efficiency.

The investigation also brought to light a relevant statistic that the truck driver connected to the WhatsApp app about 17 minutes before the collision. For the Civil Police, it is plausible that the driver was distracted with the use of the cellular device at the exact moment when he invaded the counterhand.

Excessive speed of the minibus

The health minibus also played a decisive role in the severity of the tragedy. The report extracted from the collective’s digital chronotachograph showed that the vehicle was traveling at 101 km/h at the time of the impact, exceeding the regulatory limit of the highway by 41 km/h. The testimony of one of the surviving passengers corroborated the technical data, reporting that the bus had left Imbituva with 20 minutes of delay and that the driver was driving in a "haste" way. Toxicological tests of both drivers tested negative for alcohol and drugs.

Waste of third vehicle

During the investigative work, a third vehicle was involved in the collision, once a broken silver truck was seen on the site. However, the Civil Police ruled out this possibility. Official images and records proved that the breakdowns of that vehicle were the result of an old accident and that its occupants only stopped on the sidewalk to signal the road and provide first aid to the victims.

Conclusions

As both drivers who could be held criminally responsible died in the accident, there is no need to talk about liability in the criminal sphere. However, the vast collection of expert evidence and conclusions collected in the investigation will serve to subsidize and investigate possible civil cases, guaranteeing legal protection for reparation and compensation actions to victims and their families.
