Fachin decides to remove Moraes from the inquiry into fake news

The president of Supremo Tribunal Federal (STF), Edson Fachin, withdrew the minister Alexandre de Moraes from the report of the investigation of the fake news. The decision was published on Wednesday (9) and all decisions made by Moraes in the process until today are preserved.

The investigation was opened by the Court in March 2019 and is still ongoing. At the time, the then president of STF, Minister Dias Toffoli, defended the measure as a way to combat the delivery of news that affected the honorability and safety of STF, its members and relatives. The minister also appointed Moraes as rapporteur.

Fachin’s decision comes during a crisis starring Moraes and minister André Mendonça. Last week, Moraes included charges against Mendonça in the Fake News investigation. The report said that Mendonça had, in theory, practiced a series of conducts typified as administrative improbity, abuse of authority and favoring certain political groups.

Days before, Mendonça had withdrawn the secrecy of a report from the PF that carried messages sent by the banker Daniel Vorcaro to Moraes. Vorcaro is a central target of the Operação Compliance Zero, which deals with the suspicion of billionaire financial fraud in the Master, and is currently under arrest.

On Wednesday, Fachin ordered the withdrawal of the investigation against Mendonça from the investigation of the fake news. All its contents were sent to the President of the Court himself.
