Justice considers unconstitutional use of properties to aid BRB
The Federal District Justice declared unconstitutional the law that authorized the use of public properties to financially support the Brasília Bank (BRB). The decision invalidates related administrative and corporate acts, but rejects government condemnation requests due to lack of proof of damage.

The Federal District Justice considered unconstitutional the law that allowed the local government to use public properties to reinforce the cash of the Banco de Brasília (BRB). The decision, made in direct action of unconstitutionality, reaches portions of the legislation that authorized the disposal, transfer or charge of immovable property to back the financial operations of the institution. With the judgment, the administrative and corporate acts related to the devices considered irregular lose their validity.
According to the magistrate responsible for the case, the norm “did not adequately demonstrate the public interest necessary for the use of real estate, nor did it observe requirements provided for in the Organic Law of the Federal District for the decommissioning of public goods.” The decision represents a setback for the bank, which sought alternatives to contain the crisis of trust after operations involving the Master group, investigated by the Federal Police.
Understand what the law said
The approved text authorized the government to use up to 9 public real estate as collateral or as a ballast of financial operations aimed at reinforcing the BRB cash. The assets could also integrate structures such as real estate funds for monetization in the market. The measure was seen as a way to give the state bank a boost, which faces market mistrust after the revelation of business with the Master group.
With the court decision, any operation based on that authorization becomes void. The sentence also affects acts of alienation, transfer, charging or use of assets that have been authorized by legislation declared unconstitutional. This means that any ongoing negotiations need to be reviewed or suspended.

Impacts for the bank and the government
The judge, however, stated that it is possible to resort to “other forms of financial strengthening of the bank that comply with constitutional and legal requirements.” That is, the decision does not close all doors to the BRB, but requires that any alternative respects the legal procedures and proves the public interest. The bank will have to look for new ways to rebuild its financial health.
The actions also called for the condemnation of the government of the Federal District for alleged losses caused by the editing of the law. The applications, however, were rejected for lack of proof of concrete property loss. The Justice understood that there was no demonstration of effective damage to the public coffers or to the patrimony of the Federal District.
Crisis of confidence in the BRB
The Bank of Brasilia tries to contain the crisis of trust after operations involving the Master. The Federal Police investigates suspected fraud in the purchase of about R$ 12.2 billion in credits of the institution linked to the former banker Daniel Vorcaro. The BRB’s exposure to these assets raised questions about the bank’s governance and risk management.
The judicial decision on real estate comes at a delicate moment for the institution, which seeks to regain credibility with investors and customers. The possibility of using public goods to reinforce the cash register was seen as an emergency tool, but is now limited by the strict compliance requirement of the legislation.
Next possible steps
With the declared unconstitutionality, the Federal District government and the BRB will need to evaluate alternatives that are in conformity with the Organic Law and the Constitution. The magistrate did not detail what these options would be, but indicated that there are legal ways to strengthen the bank without violating the rules of use of public goods.
The decision can still be appealed. Meanwhile, the practical effects are already felt: administrative and corporate acts based on the law lose validity, and any operation of alienation or charging of real estate is suspended. The case is still pending in the Federal District Court.
For the reader, the decision reinforces the importance of control over the use of public goods and the need for transparency in financial transactions involving state. The crisis in BRB and ongoing investigations show how administrative decisions can have profound impacts on market confidence and public asset management.
