Justice grants right to reply to Moro and prohibits new broadcast of Sandro Alex's propaganda
Decision determines a 1 minute and 30 seconds response and provides a fine of R$ 50 thousand for each new display of the content

The Justiça Eleitoral granted the candidate for the Government of Paraná Sergio Moro (PL-PR) the right of response against electoral propaganda of the coalition of Sandro Alex and Rafael Greca. The decision determines the broadcasting of a response of 1 minute and 30 seconds and prohibits the repetition of the piece, under penalty of a fine of R $ 50,000 for each new display.
The propaganda claimed that Moro, as minister of Justice and Public Security, would have known of frauds in the INSS and would not have taken measures to prevent the irregularities.
In the decision, Justiça Eleitoral considered that the propaganda exceeded the limits of political criticism by presenting as fact an accusation without proof.
According to the Regional Electoral Court of Paraná (TRE-PR), the content has transformed a subject subject to public debate into a “categorical affirmation of connivance and deliberate inertia”, capable of inducing the voter to error and compromising the normality of the electoral dispute.
The decision also highlights that the Ministry of Justice, during Moro’s administration, adopted measures to address irregularities, including a technical cooperation agreement with the INSS and actions against financial institutions related to abuses involving consigned credit.
The Electoral Public Prosecutor’s Office expressed its support for Moro’s request. In the opinion, he stated that the propaganda attributed to the candidate an alleged deliberate omission without presenting unequivocal evidence.
The right of reply will last 1 minute and 30 seconds and will be communicated in the electoral timetable destined to the opposing coalition, in the same audience blocks in which the questioned insertions were displayed.
Justiça Eleitoral also ordered Sandro Alex, Rafael Greca and the coalition to refrain from re-disclosure of advertising or similar content. Failure to comply with the decision may result in a fine of R $ 50,000 for new delivery, in addition to the other penalties provided for in electoral legislation.
