New law increases penalties for theft and robbery of fuels

Crimes of theft and theft of fuel will be punished with harsher penalties in the country. Law No. 15.517/2026, published on Wednesday (23), now considers crimes to sell and store products of illicit origin.

The norm amends the Penal Code and the Law No. 8.176/1991 and provides for stricter penalties for the subtraction of oil and derivatives, natural gas, ethanol and other fuels from refineries, storage bases, pipelines and means of transport.

Under the new legislation, the theft of these products is punishable by four to ten years’ imprisonment, in addition to a fine.

The penalty may be increased by one third when there is destruction of obstacles, participation of two or more people, abuse of trust or involvement of a public official.

The increase will be two-thirds, in cases where the crime causes consequences such as shortage of supplies, fires, environmental damage, serious bodily injury or death.

The law also called the crime fuel theft. In such cases, the penalty may be extended when the action results in damage to the operation of the companies, lack of supply, fires or environmental damage.

New Crimes

In addition to the changes in the Penal Code, the legislation provides for new crimes against the economic order related to the fuel chain.

It becomes a crime to acquire, transport, store, sell or use oil, natural gas, fuels and lubricants knowing that the products have criminal origin. The penalty is three to eight years of imprisonment and fine.

The standard also provides for punishment for those who acquire or maintain these products in situations that indicate illicit origin, such as in cases of prices incompatible with the market or offer in suspicious conditions. In this case, the penalty varies from one to four years in prison, in addition to a fine.
