Unprecedented Session: STF Will Decide Whether to Open Investigation Against Moraes

The Supremo Tribunal Federal plenary (STF) begins analyzing on Tuesday morning (15) whether Minister Alexandre de Moraes can be investigated for alleged relationship with former banker Daniel Vorcaro.

The session is scheduled for 10 am and will be broadcast on TV Justiça and the internet.

The Court’s plenary session was triggered by Minister André Mendonça, a former rapporteur on the Master case, after the Federal Police (PF) determined that Vorcaro had contacted a cell phone number assigned to the Minister.

The messages were picked up by PF from the breach of the secrecy of the former banker's cell phone, who is arrested by the investigations of Operação Compliance Zero, which investigates financial frauds in the Master and the attempted purchase of the institution by the Banco de Brasília (BRB), a public bank linked to the Government of the Federal District (GDF).

Rite

In accordance with the procedure defined by the president of STF and the new rapporteur on the case, Minister Edson Fachin, the session will open at 10 a.m.

Then the secretary of the session will read the minutes of the previous session of the Court, and Fachin will make the usual greetings to all the ministers.

The minister will call the case for trial and read the case report.

Then, the floor will be given to the Attorney General of the Republic (PGR).

After the demonstration of the prosecutor, the vote will begin.

The STF has not confirmed whether Alexandre de Moraes will be able to participate in the session.

The plenary also consists of ministers Cristiano Zanin, Flávio Dino, Nunes Marques, Luiz Fux, Cármen Lúcia and Gilmar Mendes.

The participation of Dias Toffoli is also not confirmed. Earlier this year, Toffoli said he was barred from participating in trials over the Master case after press revealed that the minister owns a resort that was bought by an investment fund linked to the bank.

The planned rite may be interrupted by a point of order, which may be raised by any minister.

In addition, a request for a hearing may be made to suspend the deliberation.

The case came to light on September 1, when André Mendonça, a former rapporteur, withdrew the secrecy of the case and referred the talks to Fachin.

According to the Constitution and the Rules of Procedure of the STF, it is up to the plenary of the Court to judge members of the court.

The investigation indicates that Vorcaro exchanged about 50 messages with the number assigned to the minister before being arrested on November 17 last year.

Moraes is not the rapporteur on the Master case in STF, but he came into contact with Vorcaro after the Barci de Moraes law firm, which belongs to the minister’s family, provided services to the bank.

On November 15, 2025, Vorcaro expressed concern about the progress of the PF investigations, which were still being processed in the first instance of Justiça Federal in Brasilia, and cited the names of the Attorney General of the Republic, Paulo Gonet, and the director general of the corporation, Andrei Rodrigues.

In the message, the former banker wrote: “Can’t we reverse this with Paulo or Andrei? Too much bullshit about that. Is that in Brasília?” he said.

Despite the citation, there is no indication that Gonet and Andrei interfered in the investigations.

The next day, Vorcaro quotes Judge Ricardo Leite, former rapporteur of the investigations in Justiça Federal, and signals that he could be the target of an arrest warrant.

“Do you think there’s a chance this will happen tomorrow morning?” the former banker asked.

On November 17, Vorcaro was arrested by the determination of the magistrate Ricardo Leite. Months later, the case was sent to the Supreme Court.

The Other Side

Since the beginning of the dissemination of the conversations, Minister Alexandre de Moraes has not specifically pronounced on the content of the messages.

After sending the conversations to Fachin, Moraes included Mendonça in the fake news investigation and accused him of directing the investigation against him for “political reasons”. Then the inclusion was undone by Fachin.

During the proceedings, the Attorney General of the Republic, Paulo Gonet, who was also quoted in the messages, defended the annulment of the PF report that found the conversations.

In the demonstration sent to the Court, Gonet said André Mendonça investigated Moraes illegally in determining the deepening of the investigation into the Master case to shred the conversations involving the minister and the former banker.

In the understanding of the prosecutor, the deepening of the examination could only occur after authorization of the plenary of the Court.
