Defense of woman accuses businessman of alleged million-dollar fraud in Ponta Grossa
Defense of woman details accusation against businessman of academies in Ponta Grossa for alleged fraud of R$ 4 million and threats
The defense of a woman who was allegedly the victim of billionaire wealth fraud in Ponta Grossa, in Campos Gerais, presented new clarifications on the case involving a well-known businessman in the academy branch. According to the victim's lawyers, the damage investigated exceeds R$ 4 million, and the businessman was denounced by the Public Prosecutor's Office of Paraná (MPPR) for two alleged crimes of stelionate and three episodes of threat.
In a video, lawyer Adrieli Andrade, who represents the woman alongside lawyer Fernando Madureira, explained the main points of the prosecution and highlighted the measures adopted by the Justice to prevent possible transfers of assets.
According to the legal representative, the entrepreneur would have used, without authorization, the credentials of access of the former partner to the Gov.br platform to carry out operations involving two companies that belonged to the woman.
The companies would have been transferred to a holding controlled exclusively by the investigating party, without the former owner receiving any payment.
Defense points to risk of loss of assets
According to Adrieli Andrade, the financial movement investigated involves a patrimony of more than R$ 4 million, including vehicles of high commercial value.
Among the assets cited by the lawyer is a Porsche Panamera, valued at approximately R $ 870,000.
In the face of the risk that the assets would be sold or transferred to third parties, the defense requested legal action to preserve the assets.
The court granted an injunction that prevents the transfer of the companies and vehicles involved in the dispute.
The restriction seeks to avoid changes in property while the case is analyzed judicially.
Ex-companion has protective measure
The complaint filed by the Public Prosecutor’s Office also involves three alleged episodes of threats against the former business partner and her mother.
As reported by the lawyer, the events motivated the adoption of protective measures in favor of women.
The court has ordered that the businessman maintain a minimum distance of 200 meters from the former companion, in addition to prohibiting any form of contact with her.
The emergency protective measure aims to preserve the safety of the victim during the progress of the case.
Lawyer highlights property violence against women
Adrieli Andrade drew attention to the recognition of property violence as one of the forms of domestic violence provided for in the Maria da Penha Law.
The legislation considers patrimonial violence conducts such as retention, subtraction or destruction of property, documents, values and economic resources belonging to women.
For the defense, the facts reported in the complaint demonstrate the importance of the legal protection of the patrimony in situations of conflicts involving old relationships.
The case involves five crimes.
In all, the Public Prosecutor’s Office attributes to the entrepreneur five alleged crimes, two of which are of sterilization and three of threat.
According to the lawyer, considering the penalties in material contest, the sum of the penalties can reach 13 years of imprisonment, if there is a conviction in the terms presented by the prosecution.
It is important to emphasize that the complaint represents a formal charge of the Public Prosecutor’s Office and does not mean that the crimes have been proven.
The entrepreneur has the right to a wide range of defences, contradictions and the presumption of innocence. The eventual criminal liability will depend on the analysis of the evidence and the decisions of the Judiciary.
