Dino takes to the STF plenary the decision on posts about Our Lady of Aparecida

Minister Flávio Dino sent to the plenary of Supremo Tribunal Federal (STF) his decision that suspended an order of André Mendonça to remove from the air publications on Nossa Senhora Aparecida. It will be up to the President of the Court, Edson Fachin, to set the date of the trial. The information was released by CNN Brazil on Monday (28).

Mendonça had ordered the removal of posts in a decision taken in the Superior Electoral Court (TSE). Dino has overturned the order and now wants the other ministers of the STF to look into the case. The sentencing to the plenary does not mean that the Supreme Court has already completed the trial.

What the STF will look like

Dino allegedly argued that the plenary should examine the limits of the individual decisions of TSE members in electoral propaganda cases and the need to submit them to the analysis of the other ministers of the Electoral Court.

The minister also pointed to the risk of censorship in the debate about Nossa Senhora Aparecida as Patron of Brazil. In the assessment presented by Dino, the proximity of October 12, the date of the homages to the saint, makes it necessary to clarify which publications can be reached by removal orders.

This is the second time in September that Dino has suspended a decision from Mendonça. The trial by the plenary of STF has not yet set a date.
