Federal Deputy Calls for Nunes Marques' Removal from TSE
Federal deputy Rui Falcão (PT-SP) requested from STF the removal of TSE president Nunes Marques from electoral duties. The request is based on the magistrate's actions in the case of the WhatsApp channel 'Exército do Lula'. The TSE is experiencing tension between Nunes Marques and the electoral general corregedor, Ricardo Villas Bôas Cueva.

Federal deputy Rui Falcão (PT-SP) has asked the Supremo Tribunal Federal (STF) to remove from electoral functions the president of the Superior Electoral Court (TSE), Nunes Marques, during the 2026 elections. The request, filed this week, is based on the actions of the magistrate in the case involving the WhatsApp group "Army of Lula". The request comes amid a scenario of tension in the Electoral Court, which opposes the president of TSE to the electoral co-director general, Minister Ricardo Villas Bôas Cueva.
The initial accusation presented by Falcão is of electoral ideological falsehood, due to decisions made between Sunday and Tuesday (13). The document traces a timeline of the tension in the Court and argues that statements made in the decisions are not proven. According to the deputy, the magistrate would have based on premises that do not find support in the autos.
Lack of evidence in decisions
Among the claims pointed out by the MP is that the channel spread misinformation recognized by TSE. However, a technical report of the body itself did not find such contents, although it did not rule out the possibility of editing or deletion. For Falcão, this lack of proof weakens Nunes Marques’ decisions and justifies his dismissal.
The deputy also cites recent episodes brought to Justiça Eleitoral, such as the allegation that Senator Flávio Bolsonaro would have as a plan to cut social program resources or withdraw from Nossa Senhora Aparecida the title of Brazil’s patron. These cases, according to the document, would reveal a pattern of decisions based on unverified information.
Tension between ministers of TSE
The TSE is going through a moment of tension starring its president, Nunes Marques, and the electoral co-director general, Minister Ricardo Villas Bôas Cueva. The background is precisely the WhatsApp channel "Army of Lula". The disagreement between the two ministers became public after conflicting decisions on the group's operation.
Initially, Nunes Marques ordered the suspension of the channel. Hours later, Cueva overturned the order, on the grounds that the elements contained in the autos do not authorize a broad restriction. In doing so, he sent the controversy to the plenary of TSE, in the expectation that the collegiate would decide the question.
New conditions imposed
In response to Cueva’s decision, Nunes Marques re-analyzed the case and conditioned the operation of the channel to the registration in Justiça Eleitoral. It also banned Lula’s campaign from disseminating false content censored by TSE and from using secondary accounts to reproduce content considered illegal. The measure was seen as an attempt to impose limits without resorting to total suspension.
The campaign has already registered the channel, but there is still a 48-hour period for it to return to air. In the meantime, Cueva insists that the case go to plenary, but Nunes Marques has not yet included the case on the agenda. The delay in inclusion has generated criticism and increased pressure on the president of TSE.
What the TSE says
The People’s Gazette contacted the TSE to obtain a position on the removal request. The space is still open for demonstration. So far, there has been no official response from the Electoral Court on the case.
Rui Falcão’s request will be examined by the STF, which may decide monocratically or take the issue to the plenary. The request is expected to generate debates about the limits of the president of TSE in electoral cases and the need to ensure impartiality in decisions.
Next steps
With the registered channel and the 48-hour timeframe underway, the trend is that the group will return to operation soon. However, the dispute between Nunes Marques and Cueva could intensify if the plenary of the TSE is triggered. The outcome of the removal request is also awaited with attention, as it may influence the conduct of the elections of 2026.
