Fine from free flow can be canceled and driver may get money back

Over 2.4 million fines remain active in Brazil; transition rule allows regularization of toll and, in some cases, request refund of paid amount

Drivers who have been fined for not paying a ticket through the free flow toll system may be entitled to cancellation of the penalty and, for those who have already paid the fine, even to the return of the money. The possibility is part of a transition rule created by the Federal Government and valid until November 16, 2026.

Since the implementation of the toll without cancellations in Brazil, 3,767,635 fines related to free flow have been registered. Of this total, 1,332,497 have already been cancelled, while another 2,435,138 remain active.

Each fine for toll evasion costs R$ 195,23. Considering the penalties already cancelled, the amount can reach approximately R$ 260 million in annulled fines.

How to cancel the fine?

The rule is especially important for drivers who have gone through a free flow gantry without possessing an automatic payment tag and have not removed the fare within the deadline.

Until November 16th, those who have a pending fee covered by the transition rule can make the payment of the toll and, with this, seek the cancellation of the corresponding fine. The measure does not mean that the toll is no longer charged: the fare for the ticket remains mandatory.

During the transition period, new autos and notifications regarding the situations covered by the measure are also suspended, in addition to the allocation of points in the National License (CNH).

Who has already paid the fine?

There is also a possibility that may interest thousands of drivers. If the person has paid the toll fee and also paid the fine of R$ 195,23, he or she may request compensation of the amount of the penalty to the body responsible for the auction. Returns do not occur automatically.

In the cases made by the National Land Transport Agency (ANTT), for example, it is necessary to submit an electronic request for restitution.

The general guidance is simple: first, the driver should check for any pending tolls and regularize the fare. Then, if the corresponding fine has already been paid, you must request the return to the body that applied the penalty.

How do I know if there is a pending toll?

Since August 24, the CNH do Brasil application has been concentrating information of registered passages in free flow systems that are already integrated at the national base. The tool allows you to consult pending rates and identify which dealership is responsible for the billing, mainly facilitating the life of those who have traveled on different highways and do not know where any open ticket has been left.

The free flow model replaces the traditional toll squares with porticoes with cameras and sensors. Whoever has the tag has the billing done automatically. Those who do not use the equipment need to pay later through the channels provided by the dealer.

With the transition rule coming to an end on November 16, the recommendation is that drivers consult any pending action as soon as possible to avoid maintaining fines.
