Flávio Bolsonaro asks STF to investigate PT deputies
The defense of Senator Flávio Bolsonaro filed a request with the STF to investigate federal deputies Lindbergh Farias and Rogério Correia for alleged false accusation. The lawmakers would have submitted 20 provocations against the senator to organs such as PGR and Federal Police.
Senator Flávio Bolsonaro (PL-RJ) has triggered the Supremo Tribunal Federal (STF) to request the opening of an investigation against the federal deputies Lindbergh Farias (PT-RJ) and Rogério Correia (PT-MG). The parliamentarian’s defense alleges that the two petistas presented, together, 20 provocations against him to different authorities, which could set up a crime of slanderous denunciation.
The request was filed by the senator’s legal team and aims to ascertain whether the accusations brought by the deputies to the STF, the Attorney General’s Office (PGR) and the Federal Police are grounded or if they were used only to generate media exposure.
Defense points to 20 provocations against the senator
According to the lawyers of Flávio Bolsonaro, Lindbergh Farias presented 18 provocations against the senator, while Rogério Correia made two others. One of the demonstrations cited in the petition, also in accordance with the defense, was jointly presented by the two deputies.
The lawyers maintain that the volume of charges does not indicate diligence, but rather the awareness that none of them is sustained in isolation. "The quantity is not a symptom of diligence, but of the science of the innocence of the Newsman: the Newsmen know that none of the provocations is sustained in isolation, and so they bet on the volume to obtain media," they add.
Accusations involve mansion, militia and environmental law
Among the episodes mentioned in the petition are charges related to an alleged dispute involving a mansion in Angra dos Reis (RJ), alleged links of Flavio with militias and an alleged performance in the processing of the General Law of Environmental Licensing for the benefit of a financial institution.
The senator’s defense denies all the accusations and claims that they were taken by parliamentarians to the STF, the PGR and the Federal Police. For lawyers, the presentation of these complaints to the authorities can characterize slanderous denunciation and, therefore, they must be formally investigated.
Order includes production of proof and due diligence
In the application submitted to STF, the lawyers also require the production of evidence and other steps deemed necessary to clarify the facts. The request foresees that these measures be adopted after the PGR has spoken about the case.
The document does not detail what evidence or proceedings would be, but indicates that the defense intends to collaborate with the investigation to demonstrate the improperity of the charges.
The aim is to find out possible slanderous denunciation
The defense asks, at the end, that the Supreme Court determine the establishment of an investigation to investigate the conduct attributed to Lindbergh Farias and Rogério Correia. The measure, if authorized, will aim to ascertain whether the accusations presented by the deputies to the authorities can constitute a crime.
The crime of slanderous denunciation is provided for in the Penal Code and occurs when someone gives cause to the establishment of a police investigation or judicial process against an innocent person, knowing of the falsehood of the imputation. The sentence can go up to eight years in prison.
The STF has not yet expressed itself about the request. The PGR has also not commented on the case so far. The Boca no Trombone Portal continues to follow the developments of this legal and political dispute.
