Kassio suspends decision and keeps Deltan Dallagnol's Senate candidacy for Paraná

Deltan Dallagnol’s candidacy for the Senate by Paraná remains valid on Sunday, after the president of the Superior Electoral Court (TSE), Kassio Nunes Marques, suspended the decision that had rejected the registration of the candidate and determined the nullity of the votes given to the plate.

With the new decision, Deltan Dallagnol continues with the registration granted with appeal and can receive votes normally during the first round of the 2026 Elections. The final validity of these votes, however, will still depend on the trial by the plenary of the TSE.

Kassio did not decide on ineligibility

In Sunday’s decision, Kassio Nunes Marques did not take credit for Deltan’s eventual ineligibility. The president of TSE looked at how the previous decision had had effects on the candidacy on the eve of the vote.

According to the decision, an individual demonstration of a minister should not generate definitive effects on the candidacy and, especially, on the votes before a collegiate demonstration of the Superior Electoral Court.

Kassio also considered the proximity of the previous decision to the beginning of the vote. The rejection had been determined on Saturday night, just hours before the opening of the electoral sections on Sunday.

The suspended decision had been made by Minister Floriano de Azevedo Marques, rapporteur of the process involving the candidacy of Deltan Dallagnol.

Judicial dispute over candidacy

Deltan’s candidacy for the Paraná Senate has been the subject of a court dispute during the election campaign.

In September, the TSE even maintained, by a majority, a injunction from Floriano Marques that suspended campaign acts of the candidate until the appeal against his registration was definitively judged.

The Regional Electoral Court of Paraná (TRE-PR) had authorized Deltan’s candidacy. The case subsequently reached TSE for the analysis of the appeal filed against the decision of Justiça Eleitoral paranaense.

On Friday (2), the Electoral Prosecutor’s Office had also submitted an opinion in favour of the candidacy. The understanding was that the administrative procedures existing when Deltan left the Federal Public Prosecutor’s Office did not result in punitive proceedings capable of preventing, at this time, its participation in the 2026 election.

What happens to the votes in Deltan?

In practice, Sunday’s decision means that the Paraná voter can vote on Deltan Dallagnol for the Senate.

Votes may be registered and considered in the electoral process, but the legal situation is not yet definitively closed. The result will depend on the subsequent decision of the collegiate of TSE on the registration of the application.

The Paraná elects two senators in the 2026 elections. The elector must choose two different candidates for the position.

The definition of Deltan Dallagnol’s candidacy will therefore continue to depend on the progress of the process in the Superior Electoral Court even after Sunday’s vote.
