The dispute between Luiz Inácio Lula da Silva (PT) and Flávio Bolsonaro (PL) won a new chapter on Thursday (22). Three days before the second round of the 2026 presidential elections, the two campaigns formalized an agreement to allow the opening of the banking, tax and telephone secrets of the candidates.

The document was submitted to the Superior Electoral Court (TSE) and establishes the commitment to make the information available simultaneously. Despite the understanding among the opponents, the measure still depends on the analysis of the minister André Mendonça, responsible for the process in Justiça Eleitoral.

The expectation presented in the agreement is that the necessary authorizations will be delivered by 23:59 this Thursday (22). The effective disclosure of the data, however, is conditional on judicial procedures.

Agreement also involves family and businesses

The commitment signed by the campaigns goes beyond the personal information of the presidential candidates. The document provides for the inclusion of family members and legal persons related to the two candidates.

The public presentation of the agreement was made by Senator Camilo Santana (PT-CE), a member of Lula’s campaign coordination, after representatives of the two political groups attended TSE.

The national president of the PT, Edinho Silva, the secretary-general of the Presidency, Guilherme Boulos, and the federal deputy Camila Jara (PT-MS) also participated in the movements in the court.

For the campaign of Flávio Bolsonaro, were present the lawyer Maria Cláudia Bucchianeri and the elected senator Deltan Dallagnol (Novo-PR).

Lawyer-related company was a point of divergence

One of the main obstacles to the conclusion of the agreement involved the company Alcazar Holdings, owned by lawyer Willer Tomaz, pointed out as a friend of Flávio Bolsonaro.

The petista campaign advocated that the company’s data should also be included in the transparency commitment. The demand provoked disagreements during the negotiations, but was eventually accepted by the PL candidate's team.

Willer Tomaz and Flávio Bolsonaro are cited in an investigation into Supremo Tribunal Federal (STF) related to suspected money laundering. The existence of the investigation does not constitute evidence of irregularities.

In contrast, Lula’s team agreed to expand the set of information that could be made available.

Among the conditions presented by the representatives of Flávio are the opening of the secrets of Marco Aurélio Santana Ribeiro, known as Marcola, former chief of staff of Lula, in addition to the disclosure of expenses with corporate cards of the Presidency of the Republic and information about the agenda of the first lady, Janja Lula da Silva.

The Challenge Began During the Presidential Debate

The discussion began on Sunday (18), during the presidential debate promoted by the Band.

At the time, Lula proposed that the two candidates authorize the disclosure of banking and telephone information, starting a sequence of public demonstrations and negotiations between the campaigns.

On Tuesday, the president sent TSE an application authorizing the opening of his own secrets and information related to family and businesses, provided that Flávio Bolsonaro made an equivalent commitment.

In the following days, the senator’s campaign presented conditions to participate in the initiative, leading the representatives of both sides to negotiate which documents would be included.

Decision is now in the hands of TSE

With the agreement signed, the next step depends on the assessment of Minister André Mendonça.

The magistrate should examine the terms presented by the campaigns and define the procedures necessary for the possible availability of the information.

Up to the time of the filing of the agreement, the signature of the document did not mean that the secrecy had already been effectively broken or that the data was available to the public.

The episode takes place in the final straight of the presidential dispute, whose second round is scheduled for Sunday, October 25.
