OAB-RJ defends Rodrigo Fux after leak of messages

The Rio de Janeiro section of the Brazilian Bar Association (OAB-RJ) released on Friday (18) a demonstration of solidarity with lawyer Rodrigo Fux, son of Supremo Tribunal Federal (STF) Minister Luiz Fux, after revelations about his relationships with banker Daniel Vorcaro.

The letter was headed by the president of the entity, Ana Tereza Basílio, and was available for new signatures. There are also 11 other lawyers.

Solidarity and defence of ethical conduct

The signatories detail that Rodrigo is a member of OAB-RJ since 2018 and highlight his performance as a teacher and "respected academic", being always recognized for his ethical performance. The president of OABRJ, Ana Tereza Basilio, members of the Board, of the Sectional Council and several lawyers and lawyers from Rio de Janeiro, all subscribers of this letter, express total solidarity with lawyer Rodrigo Fux.

Context of leaked messages

Messages extracted from Daniel Vorcaro’s mobile phone and obtained by the portal Metropolis show that lawyer Rodrigo Fux directed the banker to send an e-mail also to the secretary of his father, the minister of Supremo Tribunal Federal (STF) Luiz Fux. The address indicated belongs to the institutional domain of the Supreme Court and is compatible with the name of Patrícia Andrade Neves Pertence, chief of staff of Luiz Fux in STF.

Soon after saving each other’s contacts, the banker asks, “Will you come?” Rodrigo replies, "I won't make it, boss on the glue." The extracted content shows that both were treated as "brother" and "friend", as well as meeting for lunch and smoking cigars.

Rodrigo Fux's defense version

Rodrigo's defense says he never had lunch alone with Vorcaro and that he stayed at the Carnegie Club for just over an hour, leaving without keeping in touch with the banker. So far, however, no link with Fux had emerged other than kinship. About the parade, Rodrigo confirmed to São Paulo Sheet that he was in the cabin, but denied any personal or professional relationship with Daniel Vorcaro.

The Gazeta do Povo contacted Luiz Fux’s office, Rodrigo Fux and the email cited in the conversation. The space is still open for demonstration.

Prerogatives of Lawyers in Focus

The commercial approach or the attempt of prospecting potential clients, because they constitute acts insidious to the regular exercise of the law, translate the legitimate exercise of the law and do not characterize atypical or suspicious posture. We reaffirm that the prerogatives of the lawyers are guarantees of citizenship and the democratic rule of law, and must be fully respected by all the authorities and institutions of this country, including the Supremo Tribunal Federal.

The OAB-RJ demonstration reinforces the institutional support for the lawyer and highlights the importance of respecting the professional guarantees of the class. The case continues to repercute in the legal and political environment, with uncertain developments.
