Project seeks to require PG to disclose the destination of fine money

A project in progress at Câmara Municipal de Ponta Grossa wants to increase transparency about how much the City collects with fines and where that money is effectively applied. The Draft Ordinary Law No. 323/2026 establishes the periodic disclosure of this information in a specific area of the Transparency Portal of the City Hall.

The proposal was presented by the councilor Nurse Marisleidy and entered the House on August 27. After the order of the Board of Directors, on August 31, the text was forwarded to the Legislation, Justice and Drafting Commission (CLJR). The deadline for issuing the opinion is 18 September.

If approved, the project will allow the population to monitor not only the amount collected by the Municipality with fines, but also the bodies responsible for the auctions and the allocation of resources.

What should appear on the Transparency Portal

According to the text, the Municipality shall make information available in a clear, objective and accessible manner. Among the data provided are the total amount collected monthly, separated by the nature or origin of the fines; the total collected during the financial year; the body responsible for the application of the penalties; and the legal and budgetary use of the money.

It should also be informed which budgetary units, funds, programs, actions or projects received the values and how effectively it was applied in each purpose. The proposal also provides for consolidated reports that make it possible to compare the collection and allocation of resources between different financial years.

The data should be made available, whenever possible, in an open format to allow consultation, search and download. The update should occur monthly, until the 15th working day of the month following the collection.

Transit, environmental and tax fines are included

The project considers municipal fines those arising from the exercise of the power of oversight of the public administration. The text cites, among the examples, traffic fines whose collection belongs to the Municipality, environmental fines, tax and penalties related to urban, sanitary and posture supervision.

The relationship, however, is not limited to these categories: the proposal determines that fines whose revenue is earmarked for municipal public coffers should be covered.

According to the justification presented by the parliamentarian, the intention is to facilitate social control and allow citizens to know not only how much is collected, but how the amounts coming from the fines return to the benefit of the community.

The text argues that, although budgetary information is already available in the transparency mechanisms, the data on fines and their application may be dispersed or presented in a technical way, making monitoring by the population difficult.

The proposal also states that the measure uses the existing technological structure and does not intend to create relevant expenditure for the Municipality. If approved by the House and subsequently sanctioned, the new rule will enter into force 90 days after its official publication.

At this time, Bill No. 323/2026 has not yet been approved and continues in the process of analyzing the commissions of Câmara Municipal.
