Alcolumbre marks voting on Security PEC for Tuesday
The Senate president, Davi Alcolumbre, scheduled the next Tuesday for the voting on the Security Public PEC. The proposal is a priority for Lula's government and faces a deadlock over amendments that reduce the age of criminal responsibility. The text strengthens cooperation between the Union, states, and municipalities and toughens rules against factions.

The president of the Senate, Davi Alcolumbre, scheduled for next Tuesday the vote on the Proposal of Amendment to the Constitution (PEC) of Public Security. The decision comes after the Constitutional, Justice and Citizenship Commission (CCJ) concluded the analysis of the text on Wednesday (14.Oct.2026), but the lack of agreement on amendments related to the penal majority prevented the vote on the scheduled date.
The PEC is one of the priorities of the government of President Luiz Inacio Lula da Silva (PT) in Congress in 2026. Members of the Executive defend the approval of the text later this year, because in the next legislature the government must face difficulties, since the PL has the largest seat in the House.
Disappearance on penal majority postponement of voting
The impasse that postponed the vote began with the presentation of amendments to reduce the penal majority. The senators did not reach an agreement on the subject, which divided even the PT bench.
The initiative contradicted the strategy of Senator Teresa Leitão (PT-PE), who had negotiated with Alcolumbre the vote of the PEC without changes related to the penal majority. She advocated leaving the issue for a later discussion, to avoid the divergence compromising the approval of the text.

What changes with PEC
The proposal reorganizes cooperation between the Union, the States, the Federal District and municipalities in the area of public security and establishes measures to combat criminal factions and militias. Among the main points, the text redefines the attributions and strengthens the cooperation between the federative entities.
The PEC includes the Unified Public Security System (Susp) in the Constitution to integrate police actions from all spheres of government. It also makes it mandatory to transfer 50% of the resources of the National Public Security Fund (FNSP) and the National Penitentiary Fund (Funpen) to the States and the Federal District.
New duties and criminal hardening
The proposal extends the work of the Federal Highway Police to carry out ostensive patrol on federal railways and waterways. In addition, it structured the criminal execution in the Constitution and reinforced the role of the Criminal Police in the control of custody.
In the fight against organized crime, the PEC establishes stricter rules for militia members and organizações criminosas, forbidding benefits such as regime progression, temporary exit, provisional release and parole. It also determines the seizure and loss of assets and values arising from illicit activities, allocating the money raised to specific security funds.
Next Steps in the Senate
To be approved in the Senate, a PEC must receive at least 49 votes in favor in each of the two rounds. If the senators approve changes in the text sent by the House, the proposal will have to go back to the deputies for further analysis.
Unlike a bill, an amendment to the Constitution does not depend on presidential sanction. Promulgation, however, can only be made after the House and Senate approve the same version of the text.
The vote next Tuesday will be decisive for the advancement of the proposal, which faces resistance on sensitive issues such as the penal majority. The result will determine whether the text goes to the House or whether further negotiations will be needed.
