Attention, motoboys: rules change and old requirements return to apply
End of validity of provisional measure reinstates rules such as minimum age of 21 years, specialized course and new obligations for motorbike couriers vehicles

Motorcyclists and professionals who work with freight motors need to be aware of new changes in legislation. With the loss of validity of the Medida Provisória (MP) 1.360/2026, the requirements that had been flexible in recent months have come back to fruition.
The medida provisória ceased to take effect after not being approved by the Congresso Nacional within the constitutional timeframe. With this, the previous rules provided for in the Brazilian Transit Code (CTB) and Law 12.009/2009 were resumed.

Among the requirements that return are the minimum age of 21 years to exercise the activity, the need to have qualification in category A for at least two years and the approval in specialized course for professional performance. Also returns the mandatory use of safety vests with retroreflective devices.
The MP 1.360/2026 had temporarily removed some of these requirements, allowing more flexible rules for professionals. With the expiration of the measure, these amendments ceased to have effect.
Changes also affect the motorcycle freight
In addition to the rules for workers, motorcycles used in the paid carriage of goods also follow specific requirements. Among the points resumed are the need for authorization of the transit agency, the registration of the vehicle in the rental category and the conduct of a six-monthly inspection to check mandatory equipment and safety items.
The change directly impacts professionals who use the motorcycle as a work tool, since the regulation again requires adaptations of both drivers and vehicles used in the activities. The change occurs after the end of the 120-day term of the medida provisória, which ended on September 15, 2026. Without the definitive approval by Congress, the MP lost effectiveness and the previous norms came back into force.
Professionals who act as motor taxi drivers, motorboys and motor charters must again observe the rules provided for in the traffic legislation and regulations applicable to the category.
