Justice frees accused in case of man shot dead after ambush in PG
Defense said the Justice granted freedom with precautionary measures on Thursday (29); two other accused remain in custody

One of the three accused of involvement in the death of Luiz Rafael Buturre dos Santos, in Ponta Grossa, had the release determined by the Justice on Thursday (29), as his defense reported. The crime occurred in August in the Plateau region. The other two defendants remain imprisoned, according to the report.
According to the note sent by the defense, represented by the lawyer Piero Mocelim, the decision replaced the preventive detention with precautionary measures. The document does not specify what obligations were imposed on the accused. The names of those involved will be preserved.

Luiz Rafael was found dead with signs of physical assault and injuries caused by gunfire. According to the Public Prosecutor’s Office of Paraná (MPPR), the murder occurred on August 28, between 19:30 and 21:00, on a rural road in the Plateau region.
Defense denies involvement in murder
In the note, the defense states that the request for freedom was based on the analysis of the evidence, the follow-up of the investigations and on the steps taken at the scene of the events. According to the lawyers, the elements presented showed that the maintenance of pre-trial detention was unnecessary. The defense also maintains that his client was not involved in the murder.
“We reaffirm that our constituent had no part in the murder,” says an excerpt from the position. The release announced does not represent absolution. The defendant remains subject to judicial determinations, while the determination of his responsibility follows in the process.
Public Prosecutor’s Office points to ambush and unfounded suspicion
In addition to the complaint, attached to the case on October 16, the Public Prosecutor’s Office presents the accusation against three people and describes that the victim was allegedly lured into an ambush. According to the Prosecutor’s Office, one of the defendants used a friendship with Luiz Rafael to convince him to get into a car, under the pretext of going out to drink.
The victim was reportedly taken to an isolated stretch, where the assaults and the shootings took place.
According to the complaint, the crime was motivated by revenge related to a robbery. The MP maintains that Luiz Rafael was killed by mistake, on the basis of unfounded suspicions. The three were reported for qualified homicide, with the qualifiers of awkward motive and use of recourse that hindered or made it impossible to defend the victim. These are the charges brought by the Public Prosecutor’s Office and still depend on trial.
