Lula celebrates Security PEC and confirms ministry
The president Luiz Inácio Lula da Silva celebrated the approval of the Security Public PEC, which now moves to promulgation. He reinforced the creation of the Ministry of Public Security, with focus on intelligence and cooperation. The proposal expands the Union's powers against organized crime

President Luiz Inácio Lula da Silva (PT) celebrated on Tuesday (3) the approval of the Proposed Amendment to the Constitution (PEC) of Public Security. The proposal, which is now for promulgation, gives more power to the federal government to act against the organizações criminosas, expands cooperation between the Union, states and municipalities and provides for more severe punishments for the heads of criminal factions, who must serve a mandatory sentence in maximum security prison.
In a social network, Lula reinforced that, from the approval of the PEC, he will create the Ministry of Public Security. In the post, the president did not announce who will take over the portfolio. "We will add to this advance the creation of the Ministry of Public Security, with a focus on intelligence, planning and cooperation with states and municipalities to confront factions and militias," Lula wrote.
The president also stressed the right of the people to tranquility. "The Brazilian people have the right to work, to return home and to live peacefully. To guarantee this right is a commitment of the Government of Brazil.” The declaration reinforces the tone of public security priority in the new mandate.
Alckmin Promises Unceasing Combat
Vice-President Geraldo Alckmin also welcomed the approval of the PEC and said that from now on it will be "unceasingly combating organized crime and protecting the citizen". In a statement, Alckmin detailed the new action of the Union: "Now we will be able to act firmly in the fight against crime, together with states and municipalities. The Union will take on a greater role in protecting the citizen and putting criminals in jail. In practice, integration between police, information sharing, more resources for security.
Unremitting fight against organized crime and protection of the citizen.”
The vice president’s speech aligns with Lula’s speech and signals a change of position of the federal government in the security area, with greater protagonism of the Union.
What changes with PEC
The proposal establishes in the Constitution the Unified System of Public Security (SUSP), whose objective is to integrate the fight against organized crime among entities. According to the text, the Union, the States and the Federal District will be able to create laws in the area of public security, including intergovernmental task forces, the organization of the police and municipal guards and the socio-educational system.
Another central point of the PEC Public Security is on combating violent crimes and criminal factions. Among the measures are the mandatory detention in a maximum security or special nature criminal establishment. It is also prohibited or restricted the progression of the regime, the granting of provisional freedom, with or without bail, and temporary exit.
The PEC also allows the expropriation of any and all assets, rights or economic value involved in criminal activities. The rules apply to organizações criminosas, paramilitaries and private militia. The State will be able to confiscate assets linked to the crime, weakening the factions financially.
Name for still undefined ministry
One of the strong names to take over the new ministry is the prosecutor of the Special Group of Repression of Organized Crime (Gaeco) of Presidente Prudente (SP), Lincoln Gakiya, known for acting in the fight against the First Command of the Capital (PCC). Days before the second round, Gakiya attended a dinner at the home of lawyer Marco Aurélio de Carvalho, coordinator of Lula’s campaign in the state of São Paulo.
During the meeting, the prosecutor was consulted on the main challenges of public security and shared experiences in the fight against organized crime. But there was no invitation for the prosecutor to take office.
According to interlocutors of President Lula, the point in favor of Gakiya is his biography, because it represents the fight against organized crime in the country. However, the prosecutor does not have an established relationship with the president and would have to create this relationship of trust with Lula to be a real option to command the Ministry of Security, which has not yet happened.
Another issue is that President Lula has not yet defined names for ministries of the fourth term, which, in the evaluation of these interlocutors, can make a total difference in the time of the petista make his choice for Security. The possible roles of Fernando Haddad, Camilo Santana and André Fonteles in the fourth term have not yet been defined.
Next steps
The PEC of Public Security has been approved by the Senate and is now for promulgation. With the promulgation, the new rules come into force and the federal government gains instruments to act more effectively against organized crime. The creation of the Ministry of Public Security, announced by Lula, is expected to take place in the coming months, but the name of the holder is still unknown.
The Boca no Trombone Portal will continue to follow the developments of the PEC and the definition of the new ministry. Stay tuned for more updates on public safety and national policy.
