The end of the 6x1 scale will require changes in the organization of work in supermarkets, shops, restaurants and other establishments that operate daily. The proposal also provides for specific rules for ongoing activities such as health, transport and safety.

The PEC 221/2019 was approved by the Senate on Wednesday night, with 75 votes in favor and one against in both rounds. After passing through Congress, the text goes for promulgation, without the need for presidential sanction.

The main change is the guarantee of two days of paid weekly rest, accompanied by the reduction of the working limit from 44 to 40 hours per week. The adaptation will take place in stages, with the preservation of wages.

Trade and food will have to reorganize scales

Among the segments that will need to review the distribution of employees are supermarkets, pharmacies, shopping centers and shops that open on Sundays. Bars, restaurants, hotels and tourism services will also have to adjust their teams to maintain service during weekends and holidays.

The need for adaptation reaches even workers who already work less than 40 hours, but distribute the work on six days of the week. This is the case for some telemarketers.

The reduction of weekly hours and the number of days worked are different points: a shorter day, by itself, does not mean that the employee already has two days off.

How health, transport and safety are

The text provides for the possibility of differentiated regimes for activities that need to function continuously, in accordance with legal conditions and collective bargaining. This situation involves hospitals, emergency services, transportation, urban cleaning, security, ordinance and surveillance.

The forecast does not represent an automatic waiver of the new rules for all workers in these segments. The organization of the days will depend on the conditions applicable to each activity and the negotiating instruments envisaged.

When the changes begin

The general transition provides for two stages: after 60 days of promulgation, the two days of rest and the 42-hour weekly limit become effective. Twelve months after this first reduction, the ceiling falls to 40 hours per week. Thus, the complete adaptation will take approximately 14 months. The deadlines depend on the promulgation. Therefore, approval in the Senate does not immediately change the scales practiced by companies.
