Senate votes on Public Security PEC this Tuesday; see what could change in the fight against crime
Senator Camilo Santana (PT-CE) advocates reducing the age of criminal responsibility to 16 in cases of heinous crimes

The Federal Senate is expected to vote on Tuesday (3) on the Proposal for an Amendment to the Constitution (PEC) 18/2025, known as the Public Security PEC. The proposal, which broadens the integration between the security bodies and establishes stricter measures against organized crime, was included in the agenda by the president of the House, Davi Alcolumbre. The session is scheduled for 4 pm and also provides for the analysis of four other projects.
The PEC was approved by the Constitution and Justice Commission (CCJ) on October 14. On the same date, the senators approved the request RQS 713/2026, which allows to accelerate the processing of the matter. With this, a special schedule was established, dispensing with the five discussion sessions required for the first round vote and the three scheduled for the second round.
Presented by the Executive Power, the PEC proposes a reorganization of the Brazilian public security system. Among the main objectives are the definition of new attributions for the Union, states and municipalities, the strengthening of the joint action of the security forces and the expansion of the resources destined for the sector.
The text also provides for the inclusion of the Unified Public Security System (Susp) in the Constituição Federal, giving greater constitutional support to the integration between the bodies responsible for security.
The rapporteur made changes to the proposal.
The rapporteur of the PEC in the CCJ, Senator Rogério Carvalho (PT-SE), presented amendments to the text previously approved by the Chamber of Deputies. Of the 81 amendments tabled by the senators, four were accepted.
One of the main changes was the withdrawal of the device that provided for the allocation of resources from sports betting, known as bets, to public safety funds. On the other hand, the rapporteur maintained the forecast of directing 10% of the surplus of the Sovereign Pre-Salt Fund to finance actions in the area.
The proposal also establishes a stricter criminal regime for leaders and members of criminal factions, paramilitary organizations and militias, considering the hierarchical position and the participation of each person in the organizations.
The measures envisaged include:
Mandatory detention in maximum security prisons;
Restrictions on the progression of the regime and the granting of procedural benefits;
Possibility of confiscation, without compensation, of property related to criminal activities;
Liability of legal persons involved in illegal activities;
Special protection for whistleblowers and their families.
Amendments propose changes in penal majority
By Friday, the PEC of Public Security had received five amendments of Plenary. Two of them propose changes in the penal majority, currently established at 18 years.
Senator Camilo Santana (PT-CE) advocates reducing the penal age to 16 years in cases of heinous crimes.
Senator Rogério Marinho (PL-RN) proposes a broader change: reduce the penal age to 16 as a general rule and to 14 years in cases of heinous crimes, torture, drug trafficking and terrorism.
Other amendments deal with the extension of the responsibilities of public safety bodies.
Senator Carlos Portinho (PL-RJ) presented a proposal to allocate resources from the National Public Security Fund to Forças Armadas. The money would be used in actions of defesa civil, fighting crimes in border and environmental regions, as well as law enforcement operations.
The senator Eduardo Gomes (PL-TO), for his part, wants to include the transit agents among the public security bodies provided for in the Constitution. The proposal also attributes to these professionals the patrulhamento viário of a transit police nature.
Another suggestion of the parliamentary is to include the state and district bodies of the socio-educational system in the constitutional structure of public security.
Other projects are also on the agenda of the Senate
In addition to the PEC of Public Security, senators will be able to review four other items during Tuesday’s session.
Two of them are draft legislative decrees related to international agreements. PDS 240/2011 deals with cooperation in the area of Defense between Brazil and Guyana. PDL 575/2026 provides for the approval of a cooperation agreement on space science and technology between Brazil and Venezuela.
It is also planned to vote on the Bill (PL) 5.782/2023, which establishes the September in Flower campaign, aimed at raising awareness about gynaecological tumors. The initiative seeks to expand information on cancers that affect organs such as uterus, ovaries, vagina and vulva, diseases that are among the relevant causes of illness and death of women.
Another project on the agenda is PL 186/2025, which provides for the realization of courses, campaigns and scientific lectures to encourage positive parenting.
The proposal seeks to promote practices of raising and educating children based on respect, affection, dialogue and the imposition of limits, without the use of physical or psychological violence.
