Pastor asks Fachin to hide Marcola and Beira-Mar from CIA

A pastor filed a preventive habeas corpus in Supremo Tribunal Federal (STF) asking that the criminal leaders Marcos Willian Herbas Camacho, Marcola, and Luiz Fernando da Costa, Fernandinho Beira-Mar, be hidden from the CIA, the intelligence agency of the Estados Unidos. The document, dated June 2, 2026, was revealed by the portal Metropolis and confirmed by the Gazeta do Povo in consultation with the court system. The cleric claims that there is a risk of a "general rescue" if the two are captured by the American agency.

The request was addressed to the President of STF, Minister Edson Fachin, and also to the Attorney General of the Republic, Paulo Gonet. The pastor argues that Marcola, appointed as the leader of the First Command of the Capital (PCC), and Beira-Mar, head of the Red Command (CV), are under threat of kidnapping for having been mistakenly classified as “terrorists” by the Estados Unidos. Request cites risk of 'general salvation'

In the document, the pastor says that a possible kidnapping of the criminal leaders would generate "disturbance to the guarantee of public order" and would provoke a "general salvation". Pastor mentions increase in prison population

The author of the request also makes a remark about the prison system: "the prison population was 401,236 and today, in 2026, they are 941,752 and with [a] detail: with greater ease access to weapons as a result of the government Jair Bolsonaro". He attributes the increase in the prison population and access to weapons to the former president’s management, but does not present sources for that claim.

Preventive habeas corpus is based on article 5 of the 1988 Constitution, which guarantees the right to travel. The pastor asks that patients be “placed far from the reach of nations I have cited,” leaving the STF and the Ministry of Justice with the decision on the site. He concludes the request by stating: "I do not want destruction, in case of 'general salvation'".

Fachin denies follow-up to request

Minister Edson Fachin ruled on habeas corpus on June 22. He noted that the pastor does not point to any act attributable to an authority subject to the jurisdiction of the STF. In the request, the US government appears as impenetrable, which makes the analysis impossible by the Brazilian court.

The Constitution allows habeas corpus whenever someone suffers or is threatened with suffering an illegal threat to their freedom of movement. You don’t have to be a lawyer, and the person who makes the request doesn’t have to be the person threatened. However, the Rules of Procedure of the STF say that a habeas corpus "disauthorized" by the beneficiary should not be known.

STF receives requests from supporters
