TSE delays judgment of Deltan and keeps uncertainty over Senate vacancy for Paraná

Elected with 25.14% of the votes, former prosecutor awaits analysis of candidate registration; new date has not been announced

The trial of Deltan Dallagnol in the Superior Electoral Court (TSE) was postponed on Thursday (8). The Court removed from the agenda the appeal that questions the registration of the candidacy of the representative of the Novo, elected Senator by Paraná on Sunday (4). Until the information available this afternoon, there was no new date announced for the analysis.

The withdrawal came after the trial that determined the annulment of the votes of Anthony Garotinho (Republicans), candidate for the government of Rio de Janeiro. In the case of Deltan, the decision of the plenary on the validity of his candidacy for the Senate remains pending. He received 25.14% of the votes in the Paraná dispute.

The postponement does not represent approval or definitive rejection of the application. The decision that allowed him to participate in the election remains subject to the analysis of the ministers of the TSE.

Appeal seeks annulment of the votes of the board

According to the official agenda released by TSE, the process is the Ordinary Electoral Appeal No. 0601276-56.2026.6.16.0000, reported by Minister Floriano de Azevedo Marques. The appeal contests the decision of the Regional Electoral Court of Paraná (TRE-PR) which authorized the application.

In addition to the rejection of the registration, the request seeks the declaration of nullity of the votes assigned to the majority plate. The controversy, therefore, may affect the outcome of the Senate election on Paraná.

Public Prosecutor’s Office is at the heart of the dispute

The questioning involves the circumstances of Deltan’s exoneration from the Federal Public Prosecutor’s Office (MPF) in November 2021.

For the rapporteur, the former prosecutor anticipated the exit of the body to avoid possible consequences of disciplinary procedures and the application of the Law of Ficha Limpa. This understanding grounded the individual decision that rejected his candidacy on Saturday (3), the day before the election.

The TRE-PR had adopted another interpretation: that Deltan did not seek an exoneration for the purpose of preventing the incidence of a cause of ineligibility. It was with this understanding that the regional court deferred registration for the 2026 dispute.

Nunes Marques allowed participation in the election

On Sunday morning, the president of TSE, Minister Kassio Nunes Marques, suspended the effects of Floriano's decision.

The measure allowed Deltan to remain in the dispute and his votes to be processed normally, conditioned to trial by the plenary. Nunes Marques did not decide the merit of the controversy over ineligibility, leaving this assessment to the collegiate.

The case also resumes the discussion that led the TSE, in 2023, to reject Deltan’s registration in the 2022 federal deputy election, when he was already in office. Now, ministers will need to evaluate the record regarding the Senate candidacy in 2026.
