Pressure for Moraes' impeachment grows in the Senate

The institutional crisis at the STF and the September 7th demonstrations increased pressure on Senate President Davi Alcolumbre to schedule the impeachment of Minister Alexandre de Moraes. Opposition senators demand immediate action, while about 60 requests remain unprocessed.

The institutional crisis in the Supremo Tribunal Federal (STF) and the success of the September 7 demonstrations increased the pressure on the President of the Senate, Davi Alcolumbre (Union-AP), to guide the vote on a request for impeachment of Minister Alexandre de Moraes in the Senate. The opposition senators expanded the offensive on Alcolumbre, demanding the immediate progress in the House of the impediment process against Moraes.

The possibility of Alcolumbre making the cross-impeachment of ministers is based on scenario analyses and rumors from parliamentarians, but the senator has not discussed this possibility publicly at any time.

The opposition uses networks to collect progress

With no sessions in Congress at the moment, opposition lawmakers have been using social media to make strong public demonstrations in favor of impeachment. The opposition base criticizes the regimental maneuvers used by Alcolumbre in defense of Moraes. About 60 impeachment requests against the minister remain in the drawer of the Senate Presidency without any official referral. In addition, Senator Carlos Viana (PSD-MG) formally requested Alcolumbre’s departure from the Senate command, if the president of the House continues to hold the plenary to deliberate the process.

The Senate has 39 favorable senators.

According to a survey carried out by the Gazeta do Povo, 39 of the 81 senators said they were in favour of impeaching Moraes. Four said they were against and 23 preferred not to speak out publicly. Behind the scenes of the Senate, the expectation is that the popular outcry will convince more senators to support the impeachment of Moraes. Especially if the trial in the plenary of the STF scheduled for the next day 15 does not result in an opening of internal investigation against Moraes.

At the time, the ministers will vote to determine whether Moraes should be investigated on suspicion of receiving at least R$ 131 million to protect the former banker Daniel Vorcaro.

Crisis on STF fuels political debate

The Supreme Court is going through a serious institutional crisis. Minister André Mendonça last week released a Federal Police report with evidence that Vorcaro asked Moraes for help not to be arrested, including the containment of the Attorney General’s Office and the Federal Police. Moraes then used apocryphal intelligence reports produced within the Federal Police to try to investigate Mendonça in the Fake News Inquiry, but his action was overturned by the president of STF, Edson Fachin.

After that, on September 8, Mendonça ordered the precautionary dismissal of the director general of the Federal Police, Andrei Rodrigues, and the director of intelligence, Leandro Almada, because of the reports. His action was cancelled by Minister Flávio Dino.

Fachin tries to curb anarchy in court

Fachin then tried to contain the climate of anarchy by annulling the decisions of both Mendonça and Dino, and by taking Moraes’s report from the Fake News Inquiry. He set for the 15th a plenary session to discuss the actions of the ministers. It is still unclear if the STF will choose to investigate Moraes internally or if it will go to the stifling of the case, burying investigations under the allegation that Mendonça had not fulfilled technical formalities in the investigation that pointed to possible crimes of Moraes.

The unpredictability of the scenario in the Supreme Court is fueling the movement of parliamentarians for a possible political trial if the STF takes a hard look at the irregularities.

Senators cite examples of Collor and Dilma

“This mud tsunami is uncontrollable. Alexandre de Moraes does not have the slightest condition to remain on the STF and the omitted or conniving will pay an immense price in history, starting with the destruction of their own biographies,” Senator Alessandro Vieira (MDB-SE) said on the social network X. Carlos Portinho (PL-RJ) reinforced the demonstrations and recalled the impeachment processes of former presidents Fernando Collor de Mello and Dilma Rousseff as examples to be followed in the Senate. “I’m using all the instruments I have to press.

Fachin withdraws Moraes from the Fake News Survey

On Wednesday (9), STF President Edson Fachin removed Minister Alexandre de Moraes from conducting the Fake News Inquiry. The ordinance signed by Fachin established new rules for the processing of ongoing investigations and signaled for its end by means of archiving. The opposition needs 41 votes in plenary to approve the admissibility of the complaint in a simple vote, if Alcolumbre puts the issue on the agenda. The outcome of the crisis in the STF and the response of the Senate should dominate the political debate in the coming weeks.
