TSE suspends Deltan Dallagnol's Senate candidacy for Paraná

The suspension of Deltan Dallagnol's candidacy for the Senate by Paraná was determined by the Superior Electoral Court (TSE) through a preliminary decision of Minister Floriano de Azevedo Marques. The measure temporarily prevents the candidate from carrying out campaign acts, using public resources and participating in electoral propaganda on radio and television until the appeal is reviewed by the Court.

The decision responded to a request submitted by the Coalition Paraná For All and the Federation of Brazil of Hope, who challenged the application file previously approved by the Regional Electoral Court of Paraná (TRE-PR).

With the injunction, Dallagnol is prevented from receiving or using amounts from the Party Fund and the Special Campaign Fund (Fundo Eleitoral), including resources that may have already been made available. The decision also suspends the broadcasting of electoral propaganda and other campaign-related procedures.

Minister Floriano de Azevedo Marques also determined that the TRE-PR be communicated urgently to comply with the decision and requested that the request be analyzed by the collegiate of the TSE in the shortest possible time.

Previous understanding of TSE

The discussion on Deltan Dallagnol’s candidacy is related to a decision taken by TSE himself in 2023. At the time, the Court unanimously overturned his candidacy for federal deputy in the 2022 elections.

In that trial, the Court considered that the then Attorney of the Republic had anticipated his departure from the Federal Public Prosecutor’s Office to avoid possible consequences of administrative procedures that could result in ineligibility provided for in the Law of Ficha Limpa.

According to the understanding signed by TSE at the time, Dallagnol had procedures underway in the National Council of the Public Prosecutor’s Office (CNMP) when he requested exoneration, in November 2021.

For the Court, the early departure would have configured an attempt to avoid the application of a possible electoral restriction.

Decision for the 2026 election

In the Senate dispute in 2026, the TRE-PR had approved the registration of Dallagnol's candidacy by a majority of votes. The regional court considered subsequent facts involving administrative procedures and carried out a new analysis of eligibility conditions.

In evaluating the request to suspend the Deltan Dallagnol application, Minister Floriano stated that, in initial analysis, the new elements presented would not be sufficient to push back the understanding adopted by TSE in 2023.

According to the decision, although each election requires an analysis of the eligibility conditions, a significant change in the legal circumstances or facts would be necessary to differentiate the current case from the one already judged.

The minister also stressed that the process involves the same candidate, the same request for exoneration and the same administrative procedures previously considered by the Superior Electoral Court.

Impacts on the electoral process

In granting the injunction, the rapporteur pointed to possible impacts of the continuity of the campaign while the appeal has not yet been judged.

Among the points presented is the risk of using public resources in a candidacy that may later be considered unfeasible, in addition to the effects related to electoral propaganda and the result of the vote.

The election for the Senate in the Paraná will have two vacancies in dispute. The minister stressed that the voter will be able to choose two candidates and evaluated that a possible subsequent change could generate consequences to the electoral process.

The suspension of the application of Deltan Dallagnol remains valid until a new decision of the Superior Electoral Court on the appeal filed against the understanding of TRE-PR.
